Please read these Terms carefully because they are a binding agreement between You and Cloud-CRM. You automatically agree to these Terms and to our Privacy Statement simply by using or logging Registration into the Sites.
You may be required to create an account and specify a password in order to use certain services or features on the Sites. If your information changes at any time, please update your account to reflect those changes.
You may not share your account with anyone else. Please keep your password confidential, and try not to use it on other websites.
The personal information (such as name, company information, photos etc.) that may be collected during the course of registering for Cloud-CRM. The Success Login is subject to the Event Terms of Service. Please read those carefully.
You will be responsible for maintaining the confidentiality of your Success Login username and password, and are entirely you will be responsible for any and all activities under your Success Login account. Cloud-CRM will not be liable for any loss incurred as a result of an unauthorized use of a username/password or account.
We reserve the right to modify our Sites at any time, with or without notice to you. For example, we may add or remove functionality or features, and we may suspend or stop a particular feature altogether. We also reserve the right to charge a fee for any of our features at any time. If you don’t like any changes, you can stop using our Sites at any time.
Please do not use the Sites in a way that violates any laws, infringes on anyone’s rights, is offensive, or interferes with the Sites or any features on the Sites (including any technological measures we employ to enforce these Terms).
We reserve the right to take down Content, Features, terminate your account, prohibit you from using the Sites, and take appropriate legal actions.
Using our Site does not give you ownership of any intellectual property rights to the content you access. You may not use content from our Sites unless you obtain permission from us or its owner, or unless you are otherwise permitted by law.
Please note that by submitting Content, creating a user account or otherwise providing us with your email address, postal address or phone number, you are agreeing that we or our agents may contact you at that address or number in a manner consistent with our Privacy Statement.
If you believe any Content on the Services infringes your copyrights, you may request that remove the Content from the Services (or disable access to that Content) by following the instructions.
We provide our Services using a commercially reasonable level of care and promise to do our best to make sure you enjoy the Services.
We are not responsible for lost profits, lost data, computer failure by any Virus or the violation of your rights by any third party.
We are providing email automation software but we are not taking any type of guarantee that all sent emails will go to recipient's Inbox.
If you want to integrate any third party API's or require additional changes/development then we will run through our management and development team to assess and confirm technical feasibility. If our management agrees to take on additional development or integration then required charges will be notified to you
We may modify these Terms at any time so be sure to check back regularly. By continuing to use or log in to a Site after these Terms have changed, you indicate your agreement to the revised Terms.
Subscription Charges :
The Subscription Charges are based on the Service Plans you choose and are payable in full of your Account. You will receive Invoice/receipt of each payment done by you.
Renewal :
If your subscription is going to expire then you need to renew your subscription by making payment according to mentioned Plan. If you failed to renew your plan then your service will be stopped and you will not be able to login into CRM and lose access to your data.
Refunds :
All Subscription Charges are nonrefundable. No refunds shall be issued for partial use or non-use of the Service by you provided.
Late Payments/Non-payment of Subscription Charges :
You can check your Subscription Expiry date on the Website. We must receive payments within a maximum of fifteen (15) days from the date of Expiry. If we do not receive payment within the foregoing time period then we will remove/suspend your access & your data. We will not responsible for your data recovery.
Upgrades :
You may upgrade Your Account at any time during Your Subscription Term. When you upgrade your subscription plan then the subscription expiry date changes according to your upgraded plan.
Applicable Taxes :
The Subscription Charges do not include any taxes, levies, duties or similar governmental assessments, including value-added, sales, use or withholding taxes assessable by any local, state, provincial or foreign jurisdiction. You are responsible for paying the Taxes that would be levied against you by government authorities. We will invoice you for such Taxes if we believe we have a legal obligation to do so and you agree to pay such Taxes if so invoiced.
We shall not be liable to you or any other third party for suspension or termination of Your Account, or access to and use the Service, if such suspension or termination is in accordance with these Terms.
Free trial Customers :
If you are on a free trial for any of Our Service(s), Your Account may be suspended or terminated in the following manner:
We may suspend your access to and use of Your Account or the Service if you are in violation of the Terms. Your Account shall be terminated and all associated Service Data shall be deleted immediately and permanently.
We will terminate Your Account at any time on or before the expiry of your free trial. In such cases, all associated Service Data shall be deleted immediately and permanently.
Customers on a Service Plan :
If you are on a Service Plan for any of Our Service, Your Account may be suspended or terminated in the following manner:
In addition to suspension for late payment or non-payment of Subscription Charges, We may suspend your access to and use of Your Account or the Service if you are in violation of the Terms. Your Account shall be terminated.
We may suspend Your Account upon expiry or non-renewal of Your Subscription Term. Your Account shall be terminated and all associated Service Data shall be deleted immediately and permanently.
If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. We have the right to disable any user identification code or password.
We use appropriate technical and organizational measures to protect the Service Data that we Process. The measures we use are designed to provide a level of security appropriate to the risk of processing your Service Data.
During Your Subscription you can import your data into CRM.
Apart from the communications specified in Our Privacy Notice, We may contact you directly via e-mail to notify for any kind of service or terms.
Messages that you send through our system are delivered with a physical phone that you own. In order for us to send messages using your phone, we need you to link it with a QR Code that we will provide when you start that process. You can revoke that permission at any point from your phone's WhatsApp.
You can un-link your number whenever you want. You just need to grab your phone, then go to the Web Whatsapp section. In there you can close all active sessions, therefore, unauthorizing us to use your WhatsApp.
To link your number again you need to start a new linking process.
WhatsApp penalizes any number that sends unsolicited messages to their recipients. Your recipients, primarily, are the ones that can put your number at risk.
We recommend that you test the service using 2 phones. One that's linked with our system and another that you use as a mock client.
No. Banning is an action made directly by WhatsApp. We cannot restore your number.
WhatsApp monitors closely the type of message you send. Sending unsolicited messages (SPAM) that your recipients are not expecting or want to receive, can result in WhatsApp permanently banning your number or IP. This is an action that WhatsApp takes, and we have no control or responsibility over it.
Some cases where we are certain that your number will be banned are :
If your number is banned by WhatsApp you won't be able to use it again. The credit that remains in the account will be intact. You can continue using our system normally linking a new number. We can't guarantee that the numbers won't continue getting banned.
Text, Pictures (PNG and JPG), Audio (OGG) and Documents (PDF). You can send links containing any type of file (documents, videos, audios etc)
Text + image, text + audio or text + file must be sent separately. In one message the text, in another the file.
There is not limit. You can send and receive as many messages as you like. Current sending speed is around 500 messages per hour per registered number.
All your numbers with the status INCOMING MESSAGE "YES" will consume credit for a 24 hour session to receive unlimited messages. Numbers that you have in the INCOMING MESSAGE "NO" status will not consume credit. If you need to read incoming messages from the platform, developing a chatbot or using the Web Chat Manager, you need this option active. On the other hand, you can cancel this option and receive the replies for free directly on your phone for free.
